How Does It Work?

There are 6 steps to a formal mediation process

Introductory Remarks

The mediator will wait until both parties are present and then make introductions. The physical setting will be controlled so that no party feels threatened. Most mediators will ask that if children are present, they wait outside.

The mediator will then give an opening statement, outlining the role of the participants and demonstrating neutrality. Some mediators will make comments about what they see as the issue and confirm the case data if briefs have been pre-submitted.

Statement of the Problem

Each party is given the opportunity to present their perspective on the dispute without interruption. This allows everyone to fully understand each side's concerns and viewpoints.

Information Gathering

The mediator asks questions to clarify issues, gather additional details, and ensure a comprehensive understanding of the situation. This phase helps uncover underlying interests and concerns.

Identification of Problems

Working together, the parties and mediator identify and prioritize the key issues that need to be resolved. This creates a clear roadmap for the negotiation phase.
